I don’t see how this is as big an issue as its made out to be.
Long story not so long. Any unit rolling to hit must say it’s using markerlights BEFORE they roll to hit AND which abilities they’re using, THEN they roll to hit. The owning player of the model being targeted then gets to say if they’re going to jink or not. So if your riptide boosts it’s BS but doesn’t take ignores cover, then you still get a jink. If it takes ignore cover you can still declare to jink should the targeting player have other markerlight hits as each time they want to ignore your cover save applied by jink they must burn a markerlight hit.

Seeing as the Shooting Player with the Markerlights has to choose to use them prior to selecting a weapon, and the Jinking player can wait until to-hit rolls are about to be made, the decision to Jink clearly CAN be made after.
The problem is with Tau players who would attempt to exploit this by selecting a target and then persuading or leading their opponent to make a decision about jinking before burning markerlight tokens. (Which technically is allowed by RAW) That said, it would be horrible sportsmanship to do so.

I would specifically make my opponent declare their markerlights before deciding to jink or not. There's a very obvious order to it or at least how it was intended.
